Why Is Bingo Legal?

The second reason why bingo is legal is because it is classified as an amusement game. According to the United States Supreme Court, “An amusement device enjoys First Amendment protection as long as it does not involve any element of chance”.

This means that bingo falls under the category of amusement games which are protected by the First Amendment. This means that government officials cannot prohibit or restrict the use of amusement games based on their content or nature.

So why does bingo enjoy constitutional protection? It seems likely that this protection comes from our history as a democracy where we enjoy freedom of speech and freedom of assembly. These rights were originally intended to protect us from oppressive government rule.

By giving certain forms of amusement (like bingo) constitutional protection, we are protecting these games from government interference while still allowing people to enjoy them.
